Gender-Neutral Toy Sections: A New California Law

This law, signed by Governor Gavin Newsom in 2021, aims to promote gender equality and reduce the influence of traditional gender roles on children.
Under this legislation, traditional boys and girls sections will not be outlawed, but stores must also create a gender-neutral section. Failure to adhere to these guidelines after January 1, 2024, may result in civil penalties, which can be enforced through legal action by the state attorney general, district attorney, or city attorney. Penalties range from $250 to $500 for subsequent violations.
The law defines a childcare item as any product designed or intended by the manufacturer to facilitate sleep, relaxation, or feeding of children, or to help children with sucking or teething. This new legislation has sparked a debate on the role of gender in marketing and the impact it has on children’s development.
Some argue that this law is an unnecessary intrusion into the private lives of families, while others believe it is a step towards promoting gender equality and reducing the influence of traditional gender roles on children.
